What is an IP1 license?
The Infrastructure Provider Category-I is a telecom-relate license provide to certain businesses that can provide assets such as dark fibres, Right of Way, duct space & towers to the needful telecom business in the market. To procure such a license, the applicant must be eligible to apply for IP-I license registration. Post-eligibility requirements, the applicant must arrange for all the requisite documents that need to be submit along with the license registration application. So, in this article, we mention the following guidelines for the Infrastructure Providers Category I registration that the applicant must observe.

Eligibility:
- Company Registration: The applicant for the IP-I license must be an Indian company register under the Companies Act of 1956.
- Foreign Equity: There is no restriction on the applicant company’s foreign equity level.
- Registration Form: The Infrastructure Provider License applicant company must submit the application for registration in the prescrib form.
- Right of Way: The IP1 license applicant company shall make its arrangement for the Right of Way (ROW).
- Name Change: Change in the name of the applicant company or the licens IP-I is permit under the Companies Act of 1956.
- Response Time: The IP1 license applicant company must be inform of the approval or rejection of the application as far as practicable within 15 days of submission of the application.
- Entrants: The registration for the IP-I license must be on a non-exclusive basis without any restriction on the number of entrants.
Extra Elegibile Required Things:
- Infrastructure lease or sale: The IP-I register Company can provide dark fibres, Right of Way, duct space, and towers on a lease / rent out / sale basis to the licensees of telecom services on mutually agreed terms and conditions.
- Agreement with other IPs: The IP-I register Company must submit a copy of an agreement enter into with the other service providers or IP-II to the DOT within 15 days of the signing of such agreement.
- Compliance: IP-I register companies must provide for the use of infrastructure in a non-discriminatory manner.
- License Processing Fee: The IP1 license applicant company must pay a processing fee along with the application of Rs. 5,000/- in the form of Demand Draft/Pay Order payable at New Delhi in the name of Pay & Accounts Officer (Headquarters) DOT. The fee is non-refundable.
- Application Submission: The application must be submit to the Section Officer of the Department of Telecommunications, Room No. 713, Sanchar Bhavan, 20-Ashok Road, New Delhi-110 001.

Want to know how to apply for an Infrastructure Provider License? Before filing the application, the following documents must be submit along with the application for IP-I Registration:
- IP-1 Registration Processing Fee in Demand Draft or a Pay Order.
- Certificate of Incorporation certify copy of the applicant company and issue by Registrar of Companies. The certificate must be duly certify by the Director, Company Secretary, or the Statutory Auditors.
- Details of the Equity details of the Company: The details must include Indian Equity and Foreign Equity, both Direct and Indirect. In addition, the nationality of promoters, partners, or equity holders must be clearly state if they are Resident Indian citizens or NRIs or Foreign Nationals.
- Agreement b/w Indian Company and the Foreign partner: If there is a foreign promoter, partner, or equity holder, a certify copy of the agreement between the Indian Company and the Foreign partner.
- Foreign Direct Investment (FDI): However, If the Company’s Foreign Direct Investment exceeds 49%, a copy of FIPB approval must be submit.
Some More Requirements
- Board’s Resolution: Resolution of Board of Directors/other proof that the person signing the application is an authorized signatory. Such resolution should be sign with a stamp by a Director but not by an authorized signatory himself.
- Authorize Signature: The signature of the authorize signatory must be attest by the Company’s director or the Company Secretary consequently.
- Memorandum & Article of Association: Copy of Memorandum & Article of Association (MoA) duly certify by the Company Secretary/ Director, with the first and last page duly stamp and each page duly initial must be submitt. In addition, the clause of MoA under which the carrying IP-I business is cover must also be state.
- List of Board of Directors: The list of board members along with their nationality must be mention. Along with the details of their nationality. Whether they are Resident Indian citizens, NRI, or Foreign Nationals..
